PILP Sends Advocacy Letter on Behalf of Autistic Individual Denied Disability Accommodations
The Pennsylvania Institutional Law Project (PILP) sent an advocacy letter on behalf of its client, Ethan Shaw, who is currently incarcerated at SCI Houtzdale.
Mr. Shaw is an autistic individual currently incarcerated in the Pennsylvania Department of Corrections. In 2022, he was placed in SCI Albion’s Neurodevelopment Residential Treatment Unit (“NRTU”), a unique and effective treatment environment specifically designed for individuals on the autism spectrum. The small unit provided accommodations, activities, and well-trained staff, and served as an interpersonal support system among those incarcerated there. These accommodations were necessary and vital for Mr. Shaw’s well-being.
In 2023, Mr. Shaw was transferred from SCI Albion to SCI Houtzdale, which does not adequately accommodate his needs as an autistic individual. The transfer therefore violates the Americans with Disabilities Act (“ADA”) and is causing him ongoing harm.
PILP urges that the DOC take immediate action to return Mr. Shaw to the NRTU at SCI Albion.
